These Terms of Service ("Terms") constitute a legally binding agreement between Scarab Voice Solutions ("Scarab," "we," "us," or "our") and the business, entity, or individual that accesses or uses our Services ("Client," "you," or "your").
By accessing or using the Services, signing an order form or statement of work, clicking to accept these Terms, paying an invoice, or permitting any person to use the Services on your behalf, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity, and "you" refers to that entity.
If you do not agree to these Terms, do not access or use the Services.
These Terms incorporate by reference our Privacy Policy and any order form, statement of work, or written agreement executed between you and Scarab (each, an "Order"). In the event of a conflict, a signed Order controls over these Terms, and these Terms control over the Privacy Policy, except with respect to matters expressly governed by the Privacy Policy.
Scarab provides a platform for building, deploying, and maintaining AI-powered Voice Agents that answer inbound telephone calls for businesses. A Voice Agent can, among other things, greet Callers, answer questions, schedule appointments, capture information, and record the outcome of the call to a Client-designated customer-records or CRM system.
The Services are built upon and integrate with Third-Party Services, including a telephony and call-connectivity provider, a voice synthesis and speech-recognition provider, an AI language model provider, and Client-designated CRM systems.
The Services are designed and licensed for inbound calling only. The Services are not designed, intended, or authorized for outbound calling campaigns, telemarketing, or the automated placing of calls to consumers. Client shall not use the Services to initiate outbound calls without Scarab's prior written approval and a separate compliance review.
Scarab may modify, enhance, or discontinue features of the Services from time to time. We will use commercially reasonable efforts to notify Clients of material changes that adversely affect the core functionality of the Services.
Public demonstration on our website. Scarab may make a live, interactive voice assistant available on our website so that visitors can experience the Services (the "Demo"). The Demo is provided free of charge, "as is," and solely for the purpose of evaluating whether to become a Client. By starting or using the Demo, you ("Visitor") acknowledge that you are speaking with an artificial-intelligence system, and you consent to Scarab recording, transcribing, and processing your interaction — including everything you say — as described in our Privacy Policy. Responses generated by the Demo are AI-generated, are for general informational purposes only, may be inaccurate, and do not constitute professional advice of any kind, including medical, legal, financial, accounting, or other professional advice.
Visitors are not Clients. A Visitor using the Demo does not become a Client and is not party to any Order, but by using the Demo a Visitor agrees to be bound by this Section as a condition of access. Nothing in this Section grants a Visitor any right to the Services beyond the limited, revocable, non-transferable right to use the Demo for personal evaluation.
Demo restrictions. In addition to the Acceptable Use restrictions in Section 9, which apply equally to Visitors, a Visitor shall not, and shall not permit or assist any other person to:
Ownership. As between Scarab and any Visitor, Scarab and its licensors retain all right, title, and interest in and to the Demo and the Services, including all software, models, prompts, configurations, know-how, and other intellectual property embodied in them, and no rights are granted to any Visitor except the limited right of use expressly stated above. If a Visitor provides Scarab with any suggestion, idea, or feedback about the Demo or the Services, Scarab may use it without restriction, attribution, or compensation, and the Visitor grants Scarab a perpetual, irrevocable, worldwide, royalty-free license to do so.
No warranty; limitation of liability. The Demo is made available for evaluation only and is provided without any warranty of any kind. Sections 14 (Disclaimer of Warranties) and 15 (Limitation of Liability) apply to a Visitor's use of the Demo to the same extent as they apply to a Client's use of the Services. Scarab may monitor Demo usage for security and abuse, and may restrict, suspend, or terminate any Visitor's access to the Demo at any time, with or without notice, for any reason or no reason.
The Services are available only to businesses and to individuals who are at least 18 years of age and able to form a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account. Scarab is not liable for any loss arising from unauthorized use of your account that results from your failure to safeguard your credentials.
Client acknowledges and agrees that Scarab and its authorized personnel and Sub-Processors have access to Call Data — including call recordings, transcripts, and metadata — for the purpose of building, configuring, testing, operating, maintaining, monitoring, troubleshooting, and improving the Voice Agents provided to Client. This access is a necessary and integral part of the Services, and Client authorizes it by entering into these Terms.
Scarab will:
Client is responsible for ensuring that its Callers are informed that calls may be recorded and accessed by a support team. Scarab provides a standard opening disclosure script for this purpose, and Client agrees to deploy it as described in Section 8.
Client understands and agrees that Voice Agents are artificial intelligence systems, not human beings, and that AI-generated output is probabilistic and may be inaccurate, incomplete, delayed, or inappropriate.
Specifically, Client acknowledges that:
Scarab shall have no liability for any harm, loss, or damages arising out of or relating to AI Errors, call mishandlings, missed calls, inaccurate transcriptions, or any decision or action taken by Client, a Caller, or any third party in reliance on the output of a Voice Agent.
The Services depend on, integrate with, and are delivered through Third-Party Services, including telephony and call-connectivity providers, voice synthesis and speech-recognition providers, AI language model providers, and Client-designated CRM systems. Client acknowledges and agrees that:
Scarab is not liable for any loss, damage, delay, or interruption caused by any Third-Party Service, including any telephony outage, API failure, data loss, or security incident originating with a Third-Party Service.
Client bears primary responsibility for the lawful use of the Services in Client's business. Client represents, warrants, and covenants that, at all times during its use of the Services, Client will:
(a) Deploy required disclosures. Deploy, without modification (unless approved by Scarab in writing), Scarab's standard opening disclosure on every telephone line using a Voice Agent, informing Callers that they are speaking with an AI assistant and that the call may be recorded and accessed by a support team, and providing a means to reach a human.
(b) Comply with call recording laws. Confirm — with the advice of Client's own legal counsel where appropriate — that the disclosures and recording practices used for Client's Voice Agents satisfy the call recording consent laws of every state in which Client's Callers are located, including any state that requires the consent of all parties to a call.
(c) Comply with all applicable laws. Comply with all federal, state, and local laws, rules, and regulations applicable to Client's use of the Services, including consumer protection laws, telemarketing and calling laws, accessibility laws, and data privacy laws.
(d) Maintain a human alternative. Maintain an operational method for Callers to reach a live human being.
(e) Obtain necessary consents. Obtain and maintain all consents, permissions, and authorizations required for Scarab to process Call Data on Client's behalf.
(f) Provide accurate configuration. Provide accurate and complete business information for Voice Agent configuration, and not instruct or request Scarab to configure any Voice Agent to make false or misleading statements, to deny being an AI when a Caller sincerely asks whether they are speaking with a human, or to engage in any deceptive practice.
(g) Use the Services for inbound calling only. Not use the Services to initiate outbound calls without Scarab's prior written approval and a separate compliance review.
(h) Secure Client's own systems. Maintain appropriate security and access controls over any CRM or customer-records system into which Call Data is written, and over Client's own accounts and credentials.
Client's compliance with this Section is a material condition of these Terms. Scarab is a technology provider, does not provide legal advice, and makes no representation that any particular use of the Services will be lawful in any jurisdiction. Client is encouraged to consult qualified legal counsel regarding its compliance obligations.
Client shall not, and shall not permit any person to, use the Services to:
Scarab may suspend or terminate the Services immediately, without liability, upon discovering any violation of this Section or Section 8.
The Services are not intended for the collection or processing of highly sensitive information. Client shall not use the Services in connection with any of the following without a separate written agreement with Scarab:
Use of the Services in connection with any restricted data without a separate written agreement constitutes a material breach of these Terms, and Scarab may suspend the Services immediately upon discovering such use. Client assumes all liability arising from its use of the Services in connection with restricted data in violation of this Section.
Client shall pay all fees set out in the applicable Order, which may include a one-time build or setup fee and recurring monthly maintenance or subscription fees.
Scarab's intellectual property. Scarab retains all right, title, and interest in and to the Services, including all software, models, configurations, know-how, documentation, and all intellectual property rights therein. Except for the limited right to use the Services during the term, no rights are granted to Client by implication, estoppel, or otherwise.
Client Data. As between the parties, Client retains all right, title, and interest in and to Client Data. Client grants Scarab a limited, non-exclusive, worldwide license to host, process, transmit, and use Client Data solely as necessary to provide, maintain, and improve the Services and to comply with law.
Feedback. If Client provides suggestions, ideas, or feedback about the Services, Scarab may use that feedback without restriction or obligation, and Client grants Scarab a perpetual, irrevocable, royalty-free license to use it.
Each party ("Receiving Party") may have access to non-public information of the other party ("Disclosing Party"), including business, technical, financial, and customer information ("Confidential Information"). The Receiving Party shall: (a) use the Confidential Information only to perform under these Terms; (b) protect it using at least reasonable care; and (c) not disclose it to any third party except to its personnel and advisors who need to know it and are bound by comparable obligations. Confidential Information does not include information that is or becomes public through no fault of the Receiving Party, was already known to the Receiving Party without obligation, is independently developed, or is rightfully received from a third party. The Receiving Party may disclose Confidential Information as required by law, provided it gives reasonable notice where legally permitted. Client Data is Client's Confidential Information; the terms and pricing of the Services are Scarab's Confidential Information.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCARAB DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, SCARAB DOES NOT WARRANT THAT: (a) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (b) VOICE AGENTS WILL HANDLE CALLS ACCURATELY OR WITHOUT ERROR; (c) THE SERVICES WILL MEET CLIENT'S REQUIREMENTS OR ACHIEVE ANY PARTICULAR RESULT; OR (d) ANY ERRORS WILL BE CORRECTED. SCARAB MAKES NO WARRANTY REGARDING ANY THIRD-PARTY SERVICE.
CLIENT ACKNOWLEDGES THAT ARTIFICIAL INTELLIGENCE OUTPUT IS INHERENTLY PROBABILISTIC AND MAY CONTAIN ERRORS, AND THAT CLIENT ASSUMES ALL RISK ARISING FROM ITS RELIANCE ON THE SERVICES.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to Client.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(a) Exclusion of indirect damages. IN NO EVENT SHALL SCARAB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF SCARAB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(b) Liability cap. SCARAB'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY CLIENT TO SCARAB IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.
(c) AI and third-party carve-out. WITHOUT LIMITING THE FOREGOING, SCARAB SHALL HAVE NO LIABILITY FOR DAMAGES ARISING FROM AI ERRORS, CALL MISHANDLINGS, MISSED OR DROPPED CALLS, INACCURATE TRANSCRIPTS, OR THE ACTS, OMISSIONS, OUTAGES, OR PERFORMANCE OF ANY THIRD-PARTY SERVICE.
(d) Basis of the bargain. THE LIMITATIONS IN THIS SECTION REFLECT THE ALLOCATION OF RISK BETWEEN THE PARTIES AND ARE AN ESSENTIAL BASIS OF THE BARGAIN. THEY APPLY EVEN IF A LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to Client.
Client shall defend, indemnify, and hold harmless Scarab and its officers, directors, members, employees, contractors, and agents from and against any and all third-party claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
(a) Client's use of the Services; (b) Client's breach of these Terms, including any breach of Section 8 (Compliance), Section 9 (Acceptable Use), or Section 10 (Restricted Data); (c) Client's violation of any applicable law or regulation, including call recording, telemarketing, consumer protection, accessibility, or data privacy laws; (d) Client's failure to deploy required disclosures or to obtain required consents; (e) any claim by a Caller or other individual arising out of an interaction with a Voice Agent operated for Client; (f) any data written to, stored in, or accessed through Client's CRM or other systems; or (g) any claim that Client Data or Client's use of the Services infringes or misappropriates the rights of a third party.
Scarab will promptly notify Client of any claim subject to indemnification, permit Client to control the defense (with counsel reasonably acceptable to Scarab), and reasonably cooperate. Client shall not settle any claim in a manner that imposes any obligation or liability on Scarab, or admits fault on Scarab's behalf, without Scarab's prior written consent.
Term. These Terms begin on the earlier of your acceptance or your first use of the Services and continue until terminated as provided herein or in the applicable Order.
Termination for convenience. Either party may terminate the Services for convenience upon thirty (30) days' prior written notice, unless a longer commitment is specified in an Order.
Termination for cause. Either party may terminate immediately upon written notice if the other party materially breaches these Terms and fails to cure the breach within fifteen (15) days after notice. Scarab may terminate or suspend immediately, without a cure period, if Client breaches Section 8, 9, or 10, fails to pay undisputed fees, or if continued provision of the Services would, in Scarab's reasonable judgment, violate applicable law or expose Scarab to liability.
Suspension. Scarab may suspend the Services, in whole or in part, upon notice where reasonably necessary to protect the security or integrity of the Services, to comply with law, or to address non-payment or a breach.
Effect of termination. Upon termination, Client's right to use the Services ceases. Scarab will delete Call recordings within thirty (30) days of termination, except as required by law or as otherwise agreed. Each party will return or destroy the other's Confidential Information upon request. Termination does not relieve Client of the obligation to pay fees accrued prior to termination.
Survival. Sections 2, 5, 6, 7, 10, 12, 13, 14, 15, 16, 17 (Effect and Survival), 18, 19, and 20 survive termination.
Scarab shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, labor disputes, governmental action, power or internet failures, telecommunications or telephony outages, or the failure, interruption, or discontinuation of any Third-Party Service.
Governing law. These Terms are governed by the laws of the State of your governing state, without regard to its conflict-of-laws principles.
Binding arbitration. Except for claims for injunctive relief relating to intellectual property or confidentiality, any dispute arising out of or relating to these Terms or the Services shall be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in your city and state, and judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. To the fullest extent permitted by law, each party waives any right to participate in a class, collective, consolidated, or representative action, and disputes shall be resolved only on an individual basis.
Jury trial waiver. To the extent any dispute proceeds in court, each party knowingly and voluntarily waives any right to a trial by jury.
Time limitation. Any claim arising out of or relating to these Terms or the Services must be brought within one (1) year after the claim accrues, or it is permanently barred, except where prohibited by law.
Entire agreement. These Terms, together with the Privacy Policy and any applicable Order, constitute the entire agreement between the parties regarding the Services and supersede all prior or contemporaneous agreements, proposals, and understandings.
Amendments. Scarab may modify these Terms from time to time. We will provide notice of material changes (for example, by email or through the Services) at least thirty (30) days before they take effect. Continued use of the Services after the effective date constitutes acceptance. If Client does not agree, Client's sole remedy is to stop using the Services.
Assignment. Client may not assign or transfer these Terms without Scarab's prior written consent. Scarab may assign these Terms in connection with a merger, acquisition, financing, or sale of assets. These Terms bind and benefit the parties and their permitted successors and assigns.
Independent contractors. The parties are independent contractors. Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship.
No third-party beneficiaries. These Terms do not confer any rights on any third party, including any Caller.
Notices. Notices to Scarab must be sent to info@callscarab.com and, if to Client, to the contact information associated with Client's account. Notices are effective upon receipt.
Waiver and severability. No waiver of any provision is effective unless in writing. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain in full effect.
Publicity. Scarab may identify Client as a customer and use Client's name and logo in Scarab's customer lists and marketing materials, unless Client opts out in writing.
Export and sanctions compliance. Client represents that it is not subject to any sanctions and will comply with applicable export control and sanctions laws.

This Privacy Policy ("Policy") describes how Scarab Voice Solutions ("Scarab," "we," "us," or "our") collects, uses, discloses, retains, and protects information in connection with our artificial intelligence voice agent platform and related services (collectively, the "Services").
Scarab builds, deploys, and maintains AI-powered voice agents that answer inbound telephone calls on behalf of businesses. When a person calls a business that uses Scarab's platform, our AI voice agent handles the conversation — answering questions, scheduling appointments, capturing information, and routing the results into the business's customer records or CRM system.
Because of how our Services work, this Policy addresses two distinct groups of people:
Please read this Policy carefully. By accessing our website, purchasing our Services, or interacting with a Scarab-powered voice agent, you acknowledge that you have read and understood the practices described in this Policy.
A note on roles. For most information generated during a call, the Client — not Scarab — is the party that determines why and how that information is collected and used. In data-protection terms, the Client is generally the "controller" (or "business") and Scarab acts as the Client's "processor" (or "service provider"), handling call information only to provide the Services and only on the Client's behalf. Where Scarab collects information for its own purposes — for example, information about the Client's account or our website visitors — Scarab acts as the controller. This Policy explains both.
For clarity, the following terms are used throughout this Policy:
If you use the voice assistant on this website (our live demo), we record and transcribe the entire conversation. Each time you speak with our demo assistant, we collect an audio recording and a word-for-word transcript of everything you say, along with related technical details about the session. We — Scarab Voice Solutions — collect this information directly and act as the controller of it. Section 3.4 explains exactly what we collect and how we use it.
When you engage Scarab as a Client, or inquire about our Services, we may collect:
When an individual places an inbound call to a Client and interacts with a Scarab-powered voice agent, the following Call Data may be collected:
Callers are informed at the beginning of every call that they are speaking with an AI assistant and that the call may be recorded and accessed by a support team. Callers may request to speak with a human or may end the call at any time.
Scarab does not intentionally collect sensitive categories of Personal Information from Callers. Our platform is not designed or authorized to collect payment card numbers, Social Security numbers, government identification numbers, financial account numbers, or health information through voice agents, and Clients are contractually prohibited from configuring voice agents to collect such information without a separate written agreement with Scarab. See Section 9.

Our website offers a live, interactive voice assistant so visitors can experience how Scarab works (the "Demo"). When you start and use the Demo, we record and process your interaction directly, and — unlike information we handle on behalf of our business Clients — we act as the controller of this information. By starting the Demo, you acknowledge and agree to the collection and use described in this section.
When you use the Demo, we collect:
How the Demo works and who processes your voice. The Demo runs on the same technology stack described in Section 4: your speech is transmitted to and processed by our third-party voice-processing provider and our third-party AI language model provider in order to recognize your speech, understand you, and generate the assistant's spoken responses. Recordings and transcripts may be accessible through those providers' platforms and to authorized Scarab personnel. See Section 7 for more on our Sub-Processors.
How we use Demo information. We use Demo recordings, transcripts, and metadata to operate and secure the Demo; to respond to you and follow up on your interest in Scarab; to understand, maintain, troubleshoot, and improve the Demo and our Services; and to comply with law. We do not sell this information, and — consistent with Section 5 — we do not use Demo recordings or transcripts to train, fine-tune, or develop AI models without your separate consent. We retain Demo information in accordance with Section 10.
Your choices. Using the Demo is entirely voluntary. You may decline to use it, end the session at any time, and request access to or deletion of your Demo information as described in Section 13.
To provide the Services, Scarab relies on a small number of specialized third-party technology providers. Understanding this flow helps explain how Call Data moves through our systems:

As between Scarab and its Clients, the Client is responsible for establishing the lawful basis for processing Call Data relating to that Client's Callers, including obtaining any consents required under applicable law. Scarab provides the tools and disclosures that enable Clients to meet these obligations, but each Client is responsible for its own legal compliance. See our Terms of Service.
We share information only in the limited circumstances described below.
We engage the following categories of Sub-Processors to provide the Services. Each is bound by contractual obligations to protect information and to use it only to provide services to Scarab.

We may update our Sub-Processors from time to time. For material changes affecting the processing of Client Data, we will provide Clients with advance notice as set out in the applicable Client agreement or Data Processing Addendum. The specific identity of each Sub-Processor is available to Clients in our Data Processing Addendum and to any individual upon written request to the contact in Section 17.
Authorized Scarab personnel have access to Call Data — including call recordings and transcripts — strictly as needed to build, configure, test, maintain, troubleshoot, and improve the voice agents we provide to our Clients. Access is limited to those with a legitimate operational need and is subject to confidentiality obligations.
The business Client on whose behalf a call is handled has access to the Call Data generated for its own voice agents. Callers with questions about how a particular business uses their information should contact that business directly.
We may disclose information where we believe in good faith that disclosure is necessary to: comply with applicable law, regulation, legal process, or governmental request; enforce our agreements; detect, prevent, or address fraud, security, or technical issues; or protect the rights, property, or safety of Scarab, our Clients, or others.
If Scarab is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or a portion of its assets, information may be transferred as part of that transaction. We will require the successor entity to honor the commitments in this Policy, and we will provide notice to affected Clients where required.
Scarab does not sell Personal Information and does not share Personal Information for cross-context behavioral advertising, as those terms are defined under applicable United States privacy laws.
Telephone call recording is regulated by federal and state law. Some states require that all parties to a call be informed and consent before the call is recorded. To support compliance:
As between Scarab and its Clients, each Client is responsible for confirming that the disclosure and recording practices used for its voice agents satisfy the requirements of the states in which its Callers are located. Scarab's standard disclosures are designed for broad compliance but do not constitute legal advice.
The Services are not intended for the collection of highly sensitive information through voice agents. Clients are contractually prohibited from configuring voice agents to solicit, collect, or store the following categories of information without a separate written agreement with Scarab:

We retain information for only as long as necessary to fulfill the purposes described in this Policy, to provide the Services, and to comply with our legal obligations. Our standard retention periods are:

Clients may configure certain retention settings within the Services or request modified retention terms in writing. When a retention period expires or a Client's engagement ends, we delete or de-identify the relevant information in accordance with our data-deletion practices and applicable law.
We maintain administrative, technical, and physical safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction. These measures include:
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. In the event of a data breach affecting Client Data, we will notify affected Clients without undue delay and, where practicable, within 72 hours of becoming aware of the breach, and we will cooperate with Clients to meet any resulting notification obligations.

How to exercise your rights. Submit a request to info@callscarab.com or the contact address in Section 15. We will verify your request and respond within the timeframe required by applicable law (generally 30–45 days).
Requests relating to Call Data. Because Call Data belongs to the business Client on whose behalf a call was handled, we may need to refer certain requests to the relevant Client, or act on that Client's instructions, in order to fulfill your request. We will coordinate with the Client to help ensure your request is honored.
Authorized agents. You may use an authorized agent to submit a request on your behalf, subject to our verification of the agent's authority.
If you are a California resident, the California Consumer Privacy Act (as amended) provides the rights described above. Scarab does not sell Personal Information and has not sold Personal Information in the preceding twelve months. To exercise your rights, contact us using the details in Section 15.
Residents of states with comprehensive privacy laws (including Virginia, Colorado, Connecticut, Utah, and others) may have similar rights. We honor applicable rights for residents of all states whose laws apply to our processing.
The Services are directed to businesses and are not intended for use by children. We do not knowingly collect Personal Information from children under the age of 13 (or a higher age where required by applicable law). If we learn that we have collected Personal Information from a child in a manner inconsistent with applicable law, we will delete it. If you believe a child's information has been collected, contact us at the address in Section 15.
Scarab operates in the United States, and our Sub-Processors may process information in the United States and other countries. If information is transferred from outside the United States, that information may be processed in a country whose data-protection laws differ from those of your jurisdiction. Where required by law, we implement appropriate safeguards for such transfers, including standard contractual clauses.
We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make material changes, we will update the "Last Updated" date above and, where required, provide notice to affected Clients. The most current version will always be available on our website. Your continued use of the Services after an update constitutes acceptance of the revised Policy.
